These Terms and Conditions ("Terms") govern your use of our website, aussieshotsacademy.com (the "Site"), and your enrollment and participation in our photography courses and related services (the "Services"). By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree with all of these Terms, you are prohibited from using the Site or Services.

1. Acceptance of Terms

By accessing or using our Site or Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, including our Privacy Policy and Cookies Policy, which are incorporated herein by reference. 3. Course Enrollment and Payment

Enrollment in our photography courses is subject to availability. We reserve the right to refuse enrollment to any individual for any reason. Payment for courses is required at the time of enrollment unless otherwise specified. We accept various forms of payment, as indicated on our Site. All fees are listed in Australian Dollars (AUD) and are inclusive of Goods and Services Tax (GST) where applicable.

• Payment Plans: We may offer payment plan options for certain courses. Details of payment plans, including payment schedules and any associated fees, will be provided at the time of enrollment. Failure to adhere to the payment schedule may result in suspension or termination of your access to the course.
• Refund Policy: Our refund policy is outlined separately on our website and is incorporated into these Terms by reference. Please review our refund policy carefully before enrolling in a course. Generally, refunds are subject to specific conditions and timelines, and may be subject to a processing fee.

4. Course Content and Intellectual Property

All course content, including but not limited to lectures, presentations, videos, images, text, and software, is the intellectual property of AussieShots Photography Academy or its licensors and is protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the course content solely for your personal, non-commercial educational purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any course content without our prior written consent. Any unauthorized use of course content may subject you to legal action.

AUSSIESHOTS PHOTOGRAPHY ACADEMY MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SITE OR SERVICES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE OR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SITE AND SERVICES IS AT YOUR OWN RISK.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AUSSIESHOTS PHOTOGRAPHY ACADEMY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SITE OR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICES IN THE TWELVE (12) MONTHS PRIOR TO THE DATE OF THE CLAIM.

You agree to indemnify and hold harmless AussieShots Photography Academy, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Site or Services, your violation of these Terms, or your violation of any rights of another person or entity.

9. Termination

We may terminate your access to the Site and Services at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us at info@aussieshotsacademy.com. Upon termination, all rights granted to you under these Terms will immediately cease.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms shall be resolved through binding arbitration in accordance with the rules of the Australian Centre for International Commercial Arbitration (ACICA). The arbitration shall be conducted in Sydney, Australia. The arbitrator's decision shall be final and binding on both parties.

12. Copyright Infringement Claims

AussieShots Photography Academy respects the intellectual property rights of others and expects its users to do the same. In accordance with the Australian Copyright Act 1968, we have adopted a policy of responding to notices of alleged copyright infringement that comply with applicable law and are properly provided to us. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on the Site or through the Services, please notify our designated copyright agent with the following information:

• Identification of the copyrighted work claimed to have been infringed;

13. Course Completion and Certificates

Successful completion of a course may entitle participants to a certificate of completion from AussieShots Photography Academy. The requirements for successful completion, including attendance, participation, and assessment criteria, will be outlined in the course syllabus or other relevant course materials. We reserve the right to withhold or revoke a certificate of completion if we determine that a participant has not met the course requirements or has violated these Terms. Certificates are issued in digital format unless otherwise specified.
